Amendments to the Notaries Act

On August 1, 2020, amendments were made to the Notaries Act. The biggest changes are contained in the sections of the Act that previously stated that barristers or solicitors may be appointed as a notary public. Those sections have been amended to include licensees under the Law Society Act, which includes paralegals.

A notary public can:

  1. Witness or certify, and attest, the execution of a document;
  2. Certify and attest a true copy of a document; and
  3. Exercise the powers of a commission for taking affidavits in Ontario.
